These Terms of Service (“Terms”) govern your access to and use of the EmailLeakAlert service (“Service”) provided by Cern Reception LLC (“we”, “us”, “our”).

By creating an account, subscribing, or using the Service, you agree to these Terms.

Service Description

EmailLeakAlert monitors email addresses you submit for appearance in known data breaches and sends notifications to designated recipients.

We do not provide:

full cybersecurity protection

endpoint security

legal, financial, or insurance advice

guarantees of total breach coverage

The Service is an early-warning and visibility tool only.

Eligible Use

You represent that:

you are authorized to submit email addresses for monitoring

you will not submit addresses without lawful authority

you will use the Service in compliance with applicable laws

You may not use the Service to:

harass or surveil individuals unlawfully

violate privacy laws

reverse-engineer, interfere with, or abuse the platform

Accounts and Subscription

Paid plans are billed recurring via Stripe. You authorize us and Stripe to charge all applicable subscription fees and taxes.

You are responsible for:

maintaining accurate billing information

cancelling if you no longer wish to be billed

any charges incurred before cancellation

Fees are non-refundable except where required by law.

Breach Data and Accuracy

Our alerts rely on third-party breach sources and public data disclosures. We do not guarantee:

completeness or timeliness of breach information

that all breaches will be detected

prevention of unauthorized account access

You are responsible for implementing appropriate remediation steps.

Email Delivery

You acknowledge that:

email delivery is dependent on mail servers and user inbox settings

spam filters or blocking may impact delivery

failure to receive an alert email does not constitute service failure

Data Protection

Please review our Privacy Policy for details about how we collect and use data.

Service Availability

We aim to provide reliable uptime, but the Service is provided on an “AS IS” and “AS AVAILABLE” basis.

We disclaim all warranties, express or implied, including:

merchantability

fitness for a particular purpose

non-infringement

We may suspend or modify the Service for maintenance, security, or technical reasons.

Limitation of Liability

To the maximum extent permitted by law:

we are not liable for indirect, incidental, consequential, or punitive damages

our total liability shall not exceed the amount you paid in the prior 12 months

You agree to indemnify us against claims arising from your misuse of the Service.

Termination

We may suspend or terminate access to the Service for:

non-payment

violation of these Terms

abusive or unlawful conduct

You may cancel your subscription at any time.

Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles.
